Le Condizioni Generali di Vendita regolano l’offerta e la vendita di prodotti sul sito web quitandmove.com (“Sito”) di proprietà della QuitAndMove s.r.l. 1. Premessa
1.1. QuitAndMove svolge l’attività di promozione e commercio elettronico dei propri prodotti, su quitandmove.com, nei confronti dei soli utenti finali "consumatori".
1.2. E’ considerato "consumatore", la persona fisica che agisce con finalità non riferibili all’attività commerciale, imprenditoriale o professionale eventualmente svolta.
1.3. QuitAndMove si riserva il diritto di non dare seguito ad ordini provenienti da soggetti diversi dal "consumatore".
1.4. Queste Condizioni Generali di Vendita regolano la procedura di offerta ed acquisto di prodotti su quitandmove.com tra il consumatore/utente di quitandmove.com ed il Venditore.
2. Acquistare su quitandmove.com
2.1. Al fine di perfezionare un contratto di acquisto di uno o più prodotti sul nostro Sito dovrai compilare il modulo d'ordine in formato elettronico e trasmetterlo a QuitAndMove, per posta elettronica, seguendo le relative istruzioni.
2.2. Nel modulo d'ordine, predisposto in lingua italiana, troverai una sezione con un rinvio alle presenti Condizioni Generali di Vendita, oltre ad un riepilogo delle seguenti informazioni:
- caratteristiche essenziali di ciascun prodotto ordinato;
- prezzo del prodotto, comprese tutte le tasse e le imposte applicabili;
- modalità di pagamento utilizzabili per l’acquisto;
- modalità di spedizione e consegna dei prodotti e dei relativi costi;
- condizioni per l'esercizio del diritto di recesso e delle modalità e dei tempi di restituzione dei prodotti acquistati.
2.3. Prima di procedere all'acquisto dei prodotti, tramite trasmissione del modulo d'ordine, ti sarà chiesto di leggere attentamente le Condizioni Generali di Vendita e l’Informativa sul diritto di recesso, di stamparne una copia attraverso il comando di stampa e di memorizzarne o di riprodurne una copia per i tuoi usi personali.
2.4. Prima della trasmissione del modulo d'ordine, avrai la possibilità di individuare e correggere eventuali errori di inserimento dei dati.
2.5. Il contratto è concluso quando il Venditore riceve, per via telematica, il tuo modulo d'ordine, previa verifica della correttezza dei dati.
2.6. A contratto concluso, QuitAndMove prenderà in carico il tuo ordine d'acquisto.
2.7. Il Venditore potrà non dar corso a tuoi ordini d'acquisto che non diano sufficienti garanzie di solvibilità o che risultino incompleti o non corretti ovvero in caso di indisponibilità dei prodotti.
In questi casi, provvederemo ad informarti per posta elettronica che il contratto non è concluso e che il Venditore non ha dato seguito al tuo ordine d'acquisto specificandone i motivi.
Qualora i prodotti, presentati su quitandmove.com, non siano più disponibili o in vendita al momento del tuo ultimo accesso al sito ovvero dell'invio del modulo d'ordine, sarà cura del Venditore comunicarti, tempestivamente ed in ogni caso entro trenta (30) giorni a decorrere dal giorno successivo a quello in cui avrai trasmesso il tuo ordine al Venditore, l'eventuale indisponibilità dei prodotti ordinati. In caso di inoltro del modulo d'ordine e pagamento del prezzo, il Venditore provvederà a rimborsare quanto da te già anticipato.
2.8. Con la trasmissione telematica del modulo d'ordine, accetti incondizionatamente e ti impegni ad osservare, nei rapporti con il Venditore, queste Condizioni Generali di Vendita. Se non condividi alcuni dei termini riportati nelle Condizioni Generali di Vendita, ti invitiamo a non inoltrare il modulo d'ordine per l'acquisto dei prodotti su quitandmove.com.
2.9. Con la trasmissione del modulo d'ordine confermi di conoscere ed accettare le Condizioni Generali di Vendita e le ulteriori informazioni contenute in quitandmove.com, anche richiamate tramite link.
2.10. Concluso il contratto, il Venditore ti trasmetterà, per posta elettronica, una ricevuta dell'ordine d'acquisto, contenente un riepilogo delle informazioni già contenute nel modulo d'ordine (Condizioni Generali di Vendita, Informativa sul diritto di recesso, le informazioni relative alle caratteristiche essenziali del prodotto e l'indicazione dettagliata del prezzo, dei mezzi di pagamento e dei costi di consegna).
2.11. Il modulo d'ordine sarà archiviato presso la nostra banca dati per il periodo di tempo necessario all'evasione degli ordini e comunque nei termini di legge.
3. Garanzie ed indicazione dei prezzi dei prodotti
3.1. Le caratteristiche essenziali dei prodotti sono presentate su quitandmove.com all'interno di ciascuna scheda prodotto. Le immagini ed i colori dei prodotti offerti in vendita su quitandmove.com potrebbero tuttavia non essere corrispondenti a quelli reali per effetto del browser Internet e del monitor utilizzato.
3.2. I prezzi dei prodotti potrebbero essere soggetti ad aggiornamenti. Accertati del prezzo finale di vendita prima di inoltrare il relativo modulo d'ordine.
3.3. Le richieste di acquisto provenienti da Paesi non compresi fra quelli visualizzati nella procedura di acquisto ( non potranno essere accettate dal Venditore.
3.4. Il Venditore, in caso di esercizio del tuo diritto di recesso, ha la facoltà di non accettare la restituzione dei prodotti che siano stati alterati nelle loro caratteristiche essenziali e qualitative o che siano stati danneggiati.
4. Pagamenti
4.1. Per il pagamento del prezzo dei prodotti e delle relative spese di spedizione e consegna potrai seguire una delle modalità indicate nel modulo d'ordine.
4.2. In caso di pagamento mediante carta di credito, le informazioni finanziarie (ad esempio, il numero della carta di credito/debito o la data della sua scadenza) saranno inoltrate, tramite protocollo crittografato, alla Banca che fornisce il servizio di pagamento elettronico a distanza, senza che terzi possano, in alcun modo, avervi accesso. Tali informazioni, inoltre, non saranno mai utilizzate dal Venditore se non per completare le procedure relative al tuo acquisto e per emettere i relativi rimborsi in caso di eventuali restituzioni dei prodotti, a seguito di esercizio del tuo diritto di recesso, ovvero qualora si renda necessario prevenire o segnalare alle forze di polizia la commissione di frodi su quitandmove.com. Il prezzo per l'acquisto dei prodotti e le spese di spedizione e consegna, come indicato nel modulo d'ordine, saranno addebitati al momento della spedizione dei prodotti acquistati.
5. Spedizione e consegna dei prodotti
5.1. Il Prodotto viene consegnato tramite Corriere Espresso o raccomandata Poste Italiane entro 3 (tre) giorni lavorativi.

7. Diritto di recesso
7.1. Qualora tu non sia soddisfatto della merce ordinata, hai il diritto di recedere dal contratto concluso con il Venditore, senza alcuna penalità e senza specificarne il motivo, entro dieci (10) giorni lavorativi, decorrenti dal giorno del ricevimento dei prodotti acquistati su quitandmove.com. Ricorda che non è possibile cambiare la merce scelta con un altra.
7.2. La merce può essere restituita, entro dieci (10) giorni dalla data di ricevimento, mediante spedizione del pacco, solo dopo aver ricevuto il Numero di Reso dal Servizio Clienti.
7.3. Per l’esercizio del Diritto di Recesso, le uniche spese a tuo carico sono quelle di restituzione dei prodotti acquistati.
7.4. Per maggiore chiarezza il Diritto di Recesso si intende esercitato correttamente qualora siano completamente rispettate anche le seguenti condizioni:
- La richiesta di reso deve essere correttamente compilata e trasmessa elettronicamente (posta elettronica) a QuitAndMove entro dieci (10) giorni lavorativi dal ricevimento dei prodotti. La comunicazione può essere inviata, entro lo stesso termine, anche mediante raccomandata con avviso di ricevimento all’indirizzo di QuitAndMove s.r.l., Via Nazionale Sud, 18/E - 23823 Colico (Lecco);
- i prodotti non devono essere stati utilizzati, indossati, lavati o danneggiati;
- i prodotti devono essere restituiti nella loro confezione originale;
- i prodotti resi devono essere inviati al Venditore in una sola spedizione. Il Venditore, infatti, si riserva il diritto di non accettare capi di uno stesso ordine, resi e spediti in momenti diversi;
- i prodotti resi devono essere consegnati allo spedizioniere entro dieci (10) giorni lavorativi decorrenti dalla data in cui hai ricevuto i prodotti.
Se il Diritto di Recesso è esercitato seguendo le modalità ed i termini indicati in questo paragrafo, il Venditore provvede a rimborsare le eventuali somme già incassate per l'acquisto dei prodotti secondo le modalità ed i termini previsti. Resteranno a tuo carico unicamente le spese del reso, vale a dire quelle per la restituzione a QuitAndMove della merce acquistata.
7.5. Qualora tu decida di utilizzare il corriere indicato dal Venditore non dovrai, tuttavia, effettuare in prima persona il pagamento delle spese del reso, sarà infatti QuitAndMove a pagare, per tuo conto, il corriere trattenendo dal rimborso una somma pari al costo in precedenza sostenuto per la consegna al tuo domicilio dei prodotti acquistati. Tale metodo consente inoltre di verificare, in ogni momento, dove si trova ciascun pacco, liberandoti da qualsiasi responsabilità in caso di smarrimento o danneggiamento dei prodotti durante il trasporto.
Nel caso tu decida di utilizzare uno spedizioniere diverso da quello indicato dal Venditore, dovrai invece effettuare in prima persona il pagamento delle spese, a tuo carico, di restituzione dei prodotti acquistati. In questo caso verrà rimborsato anche il costo in precedenza sostenuto per la consegna al tuo domicilio dei prodotti acquistati.
7.6. Qualora non siano rispettati le modalità ed i termini per l'esercizio del tuo diritto di recesso, come specificato in questo paragrafo, non avrai diritto al rimborso delle somme già corrisposte al Venditore; tuttavia, potrai riottenere, a tue spese, i prodotti nello stato in cui sono stati restituiti al Venditore. In caso contrario, il Venditore potrà trattenere i prodotti, oltre alle somme già pagate per il loro acquisto.
8. Tempi e modalità di rimborso
8.1. Dopo la restituzione dei prodotti, QuitAndMove provvede all’accertamento delle condizioni ed i termini indicati nel paragrafo 7. Nel caso in cui la verifica si concluda positivamente, il Venditore provvede ad inviarti, via posta elettronica, una conferma dell'accettazione dei prodotti resi.
8.2. Qualunque sia la modalità di pagamento da te utilizzata, il rimborso è attivato dal Venditore nel minore tempo possibile e comunque entro trenta (30) giorni dalla data in cui il Venditore è venuto a conoscenza dell'esercizio del tuo diritto di recesso previa verifica della corretta esecuzione del tuo diritto di recesso ed accettazione dei prodotti restituiti.
8.3. Qualora non vi sia corrispondenza tra il destinatario dei prodotti indicato nel modulo d'ordine e chi ha eseguito il pagamento delle somme dovute per il loro acquisto, il rimborso delle somme, in caso di esercizio del diritto di recesso, sarà eseguito dal Venditore, in ogni caso, nei confronti di chi ha effettuato il pagamento.
8.4. Il tempo effettivo per il riaccredito o la restituzione delle somme da te pagate per l'acquisto dei prodotti dipende dalle modalità di pagamento utilizzate:
- acquisto con carta di credito/debito: il tempo necessario per visualizzare il rimborso dipende dall'istituto che ha emesso la carta. Ti ricordiamo che la data valuta del riaccredito è la stessa dell'addebito, quindi non subirai alcuna perdita in termini di interessi bancari.
- acquisto tramite PayPal: il rimborso verrà effettuato sul tuo conto PayPal e sarà immediatamente visibile. Il rimborso effettivo sulla carta di credito dal tuo conto PayPal dipende dall'istituto che ha emesso la carta.

10. Legge applicabile e soluzione delle controversie
10.1. Le Condizioni Generali di Vendita sono regolate dalla legge italiana ed in particolare dal decreto legislativo 6 settembre 2005 n. 206, sul codice del consumo, con specifico riferimento alla normativa in materia di contratti a distanza e dal decreto legislativo 9 aprile 2003 n. 70 su taluni aspetti concernenti il commercio elettronico.
10.2. In caso di disservizio o controversia tra QuitAndMove e un nostro utente/cliente, garantiamo sin d'ora la nostra partecipazione ad un tentativo di conciliazione amichevole che l'utente potrà promuovere davanti a RisolviOnline, un servizio indipendente e istituzionale fornito dalla Camera Arbitrale della Camera di Commercio di Milano, che consente di raggiungere un accordo soddisfacente, con l'aiuto di un conciliatore neutrale e competente, in un modo amichevole e sicuro. 1. Premise
1.1. QuitAndMove engages in the promotion of its products and electronic commerce on quitandmove.com, towards the end users themselves "consumers".

2. Buying on quitandmove.com

4. Payments

If the return right is exercised by following the procedures and time limits specified in this paragraph, the Seller shall refund the amounts paid for the purchase of products in accordance with the procedures and deadlines.
